are these grace notes or 'normal' notes?

They certainly appear to be grace notes - they are small, and don't fit into the normal flow of rhythm. Anything in particular that makes you doubt they would be grace notes?

I am 100% sure that the first picture has grace notes and I have no doubts there but how about the second picture?

Grace notes. Count the notes in both staves - they only match if you treat the small notes as grace notes (ie uncounted). Also look at the alignment of the notes in both staves - the small (grace) notes don't align.
