Pedal not being held down. Maybe because of appoggiatura?
Unless I'm hearing it wrong, it seems that notes aren't being held through the pedal in measures 36 and 38. I've had similar issues before and I have no idea what's causing it.

I thin it's just an auditory illusion - the pedal is playing back, but the effect isn't as prominent in those measures because there isn't as much happening on the first beat (no bass not in 36 and only a single note melody, no melody notes in 38). Try adding more notes on the downbeat and you'll definitely hear the sustain more clearly.
