Personally, I would prefer measure 1. But if the general feel of the piece is 3+2+2+2 rather than an isolated measure or a short episode then measure 2 might be more appropriate.

But looking at the lower stave in the context if the upper staff. it would probably be better as a dotted quarter (crotchet) tied to a dotted half (minim) rather than a whole (semibreve) tied to an eighth (quaver).

the most of the piece is in 4/4, there are only three short sections in 9/8.
Wonder, if the tempo should be the same, so: one quarter of 4/4 is one dotted quarter in 9/8.

I would be tempted to play it with a constant eighth beat so those measures would have four beats with the first beat elongated by an eighth relative to the 4/4. It would go 1 and a 2 , 3, 4. But context is everything. If it is not your piece, can you ask the composer?
