Download from where? Is a thorny argument, better to be cautious...
I don't think download is illegal. Recording you students neither, if they agree. Only publishing might be illegal and violate copyright

Asking for legal advice on internet fora is always a bad idea, butjust not have Jojo's advice left uncommented: at least in Germany downloading scores still protected by copyright law is ilegal. Here the law for music is explicitly much more restrictive than that for other copyright protected works of art. Only handwritten (!sic) copies are permitted for personal use. USA copyright law has so-called 'fair use' but I strongly doubt that giving proteced material to students would still be considered 'fair use'.

Well, at least you won't get prosecuted for download, only for uploading, sharing, performing in public
Legal issues aside: if you earn money thru teaching, it'd be only fair to pay for the scores you use for teaching.
So there's also a moral side to this.
